These Terms & Conditions apply to purchases made from MØBLER through our website, showroom, quotations, invoices, email or other agreed methods.
By placing an order or paying a deposit, you agree to these Terms & Conditions.
Nothing in these Terms & Conditions excludes or limits any rights you may have under the Australian Consumer Law.
1. Pricing & Quotations
All prices are in Australian dollars and include GST unless otherwise stated.
Quotations are valid for 14 days unless otherwise specified.
Pricing may change before an order is confirmed due to movements in supplier pricing, exchange rates, freight or other import-related costs.
Once an order has been accepted and the required payment received, the agreed price will not change unless you request an amendment to the order or additional services are required.
2. Orders
An order is confirmed once MØBLER has accepted the order and received the required deposit or payment.
We may decline an order before acceptance where a product is unavailable, discontinued, incorrectly priced or cannot be supplied in the requested specification.
If payment has already been received and we cannot accept the order, the relevant amount will be refunded.
3. Special & Made-to-Order Products
Many MØBLER pieces are manufactured specifically for each customer in Denmark or elsewhere in Europe.
A Special Order includes products ordered in a particular timber or finish, fabric or leather, colour, size, configuration or other customised specification.
Please check all specifications carefully before approving your order.
Once a Special Order has been submitted to or accepted by the manufacturer, changes or cancellations may not be possible.
If cancellation is requested after the order has been submitted to or accepted by the manufacturer, or after production, procurement or other commitments have commenced, MØBLER may recover or retain reasonable costs already incurred or irrevocably committed in connection with the order, to the extent permitted by law.
Where an order confirmation, quotation or invoice records the agreed product specification, customers should review it carefully and notify MØBLER of any discrepancy before approving the order or paying the required deposit.
4. Deposits & Payment
The deposit required will be stated on your quotation or invoice.
Unless otherwise agreed in writing, the balance must be paid in cleared funds before goods are dispatched, collected or delivered.
MØBLER may withhold delivery while an amount properly due under the order remains unpaid.
5. Lead Times
Manufacturing and delivery timeframes are estimates unless expressly confirmed in writing as guaranteed.
As many of our products are manufactured and imported from Europe, lead times may be affected by manufacturing schedules, European holiday periods, international freight, customs, biosecurity, port delays and other circumstances outside our reasonable control.
We will keep you informed of material delays where reasonably possible.
Where a significant delay occurs, we will work with you in good faith to determine an appropriate solution having regard to the circumstances and your rights under the Australian Consumer Law.
Nothing in this section limits your rights under the Australian Consumer Law.
6. Natural Materials & Finishes
Many MØBLER products are made using natural materials and traditional craftsmanship.
Timber, leather, marble, stone and textiles may naturally vary in colour, grain, texture, veining, markings and appearance.
Natural timber and leather may also develop in colour and character over time.
Samples, website images and photography are intended as a guide only and may vary from the finished product.
These natural variations are not, by themselves, considered defects.
7. Product Dimensions & Access
Customers are responsible for ensuring products are suitable for their intended space and can reasonably be delivered into the property.
Please check product dimensions, doorways, hallways, stairs, lifts, ceiling heights and other access restrictions.
If access may be difficult, please advise MØBLER before placing your order.
8. Delivery
Delivery charges are additional unless expressly included in your quotation.
You must advise us before delivery of any unusual access requirements, including stairs, restricted parking, lift bookings, long carrying distances or difficult site access.
Additional reasonable charges may apply where delivery conditions materially differ from those disclosed when delivery was quoted.
If delivery cannot be completed because suitable access has not been provided, reasonable redelivery and storage charges may apply.
9. Storage
Once your goods are available, we will contact you to arrange delivery or collection.
Where goods cannot be accepted within a reasonable period, storage charges may apply.
We will notify you before storage fees commence and advise you of the applicable charge.
10. Change of Mind & Cancellations
Please choose carefully.
MØBLER is not required to provide a refund or exchange where you simply change your mind, choose the wrong size, colour, finish or configuration, or no longer require the product.
Special Orders and customised products generally cannot be returned for change of mind once the order has been submitted to the manufacturer or production or procurement has commenced.
Nothing in this section affects your rights where goods are faulty, defective, incorrectly described or otherwise fail to meet a consumer guarantee under the Australian Consumer Law.
11. Faults, Warranties & Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to repair, replacement, refund or other remedies where goods fail to meet an applicable consumer guarantee.
Certain products may also include a manufacturer's warranty.
Manufacturer warranties are additional to, and do not replace, your rights under Australian law.
If you believe a product has a fault, please contact MØBLER with your order details, a description of the issue and photographs where appropriate.
12. Floor Stock & Display Products
From time to time, MØBLER may sell showroom, display, clearance or ex-display products.
These items may show signs of display or handling.
Any significant marks or imperfections known to us will be disclosed before purchase where reasonably practicable.
Your rights under the Australian Consumer Law continue to apply.
13. Website Information
We take reasonable care to ensure information on our website is accurate.
However, manufacturers may update products, finishes, specifications or availability from time to time, and occasional errors may occur.
Colours may also vary depending on lighting, photography and screen settings.
If a material error affects your order, we will contact you and work with you to resolve it reasonably.
14. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
To the extent permitted by law, MØBLER is not responsible for loss or damage to the extent that it results from misuse, improper care, unauthorised modification, installation performed by a third party, or access or site conditions that were not disclosed to MØBLER before delivery or installation.
15. Privacy
Personal information collected by MØBLER will be handled in accordance with applicable Australian privacy laws and our separate Privacy Policy.
16. Changes to These Terms
MØBLER may update these Terms & Conditions from time to time.
Any updated terms will apply to future orders and will not retrospectively change the agreed terms of an existing confirmed order unless required by law or agreed with you.
17. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
